By accessing or using SmashCost ("the Service," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. SmashCost is operated by Camilo Caner, a sole proprietor based in Paraguay.
SmashCost is a bring-your-own-key (BYOK) AI inference gateway that routes API requests to third-party AI providers (OpenAI, Anthropic, Groq, Google, and others) using API keys you provide. We analyze request characteristics and optimize routing for cost and quality based on your usage patterns.
No Savings Guarantee. SmashCost does not guarantee any specific cost savings. Routing decisions are algorithmic estimates; actual costs depend on third-party provider pricing, your usage patterns, and market conditions beyond our control. Projected savings shown in the dashboard are estimates only and may not reflect actual billing from your AI providers.
You must be at least 18 years old and have full legal capacity to enter into a binding contract to use the Service. By using SmashCost, you represent that you meet these requirements. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.
You provide your own API keys for third-party AI providers. By doing so, you acknowledge and agree that:
Third-party provider changes. SmashCost is not responsible for any changes introduced by AI providers (OpenAI, Anthropic, Groq, Google, and others), including but not limited to: pricing changes; API changes or deprecations; rate limits or quota reductions; service outages or degraded performance; model behavior changes or capability regressions; policy updates that restrict how their models may be used. Such changes may affect the Service without warning and without liability to SmashCost.
SmashCost offers a free observation tier with no charge. Paid tiers (Pro, Growth, Business) unlock active routing and additional features. Current pricing is displayed at smashcost.com/#pricing and is subject to change with reasonable notice.
Payments are processed exclusively by Paddle.com, who acts as the Merchant of Record for all transactions. By subscribing you also agree to Paddle's Terms of Service. SmashCost does not process or store your payment card information.
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us.
All subscription fees are non-refundable except as expressly required by applicable law. SmashCost provides a free observation tier specifically so you can evaluate the service before committing to a paid plan.
If you believe you were charged in error (e.g., duplicate charge, charge after documented cancellation), contact us at support@smashcost.com within 14 days of the charge with documentation and we will review your case. Paddle may issue refunds on our behalf where required by their policies or applicable consumer protection law.
Partial-month refunds are not issued for early cancellations. If you cancel mid-cycle, access continues until the end of the paid period.
Certain features of the Service may be designated as beta, preview, experimental, or early access. Such features are provided without warranty of any kind and are subject to the following conditions:
Your use of any beta or early access feature is entirely at your own risk.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that: (a) the Service will be error-free or available at any particular time; (b) routing decisions will achieve any specific cost reduction; (c) the Service will be compatible with your existing infrastructure; or (d) any defects will be corrected on any particular timeline.
Although SmashCost implements industry-standard security controls, no internet-connected service can guarantee absolute security. You acknowledge that security incidents, unauthorized access attempts, data breaches, provider outages, or infrastructure failures may occur despite reasonable precautions.
SmashCost shall not be liable for losses resulting from: (a) security incidents that occur despite implementation of reasonable safeguards; (b) failures attributable to third-party infrastructure (cloud hosting, AI providers, payment processors); (c) attacks or vulnerabilities not known to exist at the time of deployment; or (d) your failure to maintain reasonable security practices on your own systems and accounts.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMASHCOST AND ITS OWNER(S), EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
In any case, SmashCost's total aggregate liability to you for all claims arising under or relating to these Terms shall not exceed the greater of (a) USD $100 or (b) the total fees paid by you to SmashCost in the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless SmashCost and its owner, officers, agents, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party AI provider's terms of service; (d) content or prompts you transmit through the Service; or (e) any claim that your use of the Service caused harm to a third party.
You may not use SmashCost to:
We reserve the right to suspend or terminate — immediately and without refund — any account that: abuses the platform; attempts to bypass limits or security controls; conducts unauthorized security testing; or violates any third-party provider's terms in a way that creates risk for SmashCost or other users.
Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continuing to provide the Service poses a legal or security risk. Upon termination, your right to access the Service ceases immediately. Provisions regarding limitation of liability, indemnification, and dispute resolution survive termination.
The Service integrates with or links to third-party services (AI providers, Paddle, Railway hosting). We are not responsible for the content, accuracy, availability, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.
These Terms are governed by and construed in accordance with the laws of the Republic of Paraguay, without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in Asunción, Paraguay.
You waive any right to bring claims as a class action or representative proceeding to the fullest extent permitted by applicable law.
We may update these Terms from time to time. We will notify registered users of material changes by email or by posting a notice in the dashboard. Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree with material changes, your remedy is to cancel your subscription and stop using the Service.
